Critical Issues:  Affiliate Abuse and Ring-Fencing
        Mechanisms    3:30 - 4:30

"Ring-Fencing" and Affiliate Abuse Issues:  Due to recent events in the energy industry, including the implosion of Enron in late 2001, we have seen investigations into the trading activities of numerous marketers and the general glut of electricity in the marketplace and a resulting general trend towards electric utility bond downgrades.  Because of the recent trend of rating agencies to consolidate utilities and non-regulated affiliated companies when evaluating risks, there has been increasing concern over the impact of non-regulated ventures upon the utility's access to debt and equity capital and the corresponding cost of such capital as well as the prospect of the utility being pulled into bankruptcy by its parent's insolvency.  As a consequence, ring fencing techniques (the isolation of a utility from the activities of its parent) are gaining the attention of regulators.  Don't miss the opportunity to explore this critical issue.

Point - Counterpoint Discussion:
Dr. Fred S. Grygiel, Chief Economist, New Jersey Board of Public Utilities
Michael G. Banta, Esq., Energy Consultant, Formerly with IPALCO
